1. Agreement to Terms

Welcome to glean.name, a trademark search and brand name checking service operated by TMZap Incorporated (d/b/a Glean). These Terms of Service ("Terms") govern your access to and use of our website, search results, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

You must be at least 18 years old to use the Service.

2. Service Description

Glean.name provides a free preliminary U.S. trademark screen using your proposed name and business description, plus selected domain checks. Results may include similar marks, related goods or services, explanations, and unverified lookup statuses. A preliminary finding is not a guarantee of availability or a comprehensive clearance opinion.

When saving is available, you may keep the original dated result in a GleanMark account. Saving, reopening, requesting an email copy, and printing that snapshot do not run additional analysis or consume paid search credits. Additional GleanMark research is a separate action.

Existing Glean.name search-pack accounts, balances, and checkout remain separate from this free preliminary workflow. Previously purchased searches do not expire and are not converted by saving a preliminary result. See the account and search-pack links on the What’s free page.

Your use of third-party services (such as Stripe, domain providers, or AI platforms) is governed by their respective terms and policies.

3. AI Features and Limitations

• AI-generated outputs may be inaccurate, incomplete, or outdated.
• USPTO data is public and may be incomplete, delayed, or inaccurate.
• Our screening covers USPTO federal records only. It does not cover state, common law, or international marks.
• Risk ratings are algorithmic estimates, not predictions of legal outcomes.
• Domain availability can change rapidly and is not guaranteed.
• Use of the Service does not create an attorney-client relationship.
• You should consult a qualified trademark attorney before adopting or filing a brand name.

4. Your Responsibilities

You agree to:

• Provide accurate information when using the Service.
• Use the Service only for lawful purposes.
• Not use automated scripts, bots, or scrapers to access the Service.
• Not attempt to gain unauthorized access to our systems or other users' data.
• Not reverse engineer, resell, or redistribute reports without permission.
• Use the outputs responsibly and not as a substitute for legal advice.

5. Payments, Fulfillment, and Refunds

For paid Glean.name search packs, prices are shown at checkout in US dollars and payment is required before purchased credits are added. The preliminary name check and its saved snapshot are free. Payments are processed securely by Stripe, Inc. We do not store your card numbers.

Fulfillment

Fulfillment occurs when search pack credits are added to your account after payment. Credits never expire and are available for immediate use. If we cannot deliver your search results, please contact support.

Refund Policy (Buyer Beware)

All sales are final except in limited cases. We will issue a refund only if search results were not delivered or there are clear, verifiable errors. Examples include missing results or obvious data corruption.

• We do not issue refunds because you decide not to use a name or disagree with a risk rating.
• We do not issue refunds for conflicts found outside the USPTO data set.
• We may offer corrections or a regenerated report in lieu of a refund.

To request a refund review, contact support@glean.name with your report ID and a description of the issue.

6. Intellectual Property

USPTO data is public domain. The Service, including software, algorithms, branding, and report format, is owned by TMZap Incorporated and protected by intellectual property laws.

• The "Glean" brand and related trademarks are licensed from Glean IP Holdings Inc.
• We do not claim ownership of the names generated for you.
• We do not guarantee exclusivity; similar names may be generated for others.
• You receive a limited, non-exclusive license to use the report for your internal business purposes.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that any name is available, registrable, or free from conflicts. You assume all risk for decisions made based on the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLEAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE REPORT THAT GAVE RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Glean, TMZap Incorporated, and our officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Suspension and Termination

We may suspend or terminate access to the Service at any time for security, legal compliance, or violations of these Terms. You may stop using the Service at any time.

Suspension or termination does not entitle you to a refund except as described in Section 5.

11. Dispute Resolution and Arbitration

Informal Resolution First

If you have a dispute with us, please contact us at legal@glean.name. We will work in good faith to resolve disputes within 60 days before either party may initiate arbitration.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures.

• The arbitration shall be conducted in Delaware, United States.
• The arbitrator's decision will be final and binding.
• Each party shall bear its own costs and attorneys' fees, unless the arbitrator awards fees to the prevailing party.
• The arbitrator may award injunctive or declaratory relief only in favor of the individual party seeking relief.

Class Action Waiver

YOU AND GLEAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Exceptions

Either party may bring a lawsuit in court for claims related to intellectual property infringement or for small claims court matters that qualify.

Time Limit for Claims

Any claim arising out of or relating to the Service must be filed within one (1) year after the claim arose, or it will be barred to the fullest extent permitted by law.

Opt-Out Right

You may opt out of arbitration by sending written notice to legal@glean.name within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts of Delaware.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and may notify you by email or by posting a notice on our site. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Miscellaneous Provisions

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign these Terms without our consent. We may assign them freely.
• Waiver: Failure to enforce any provision is not a waiver of our right to do so later.
